Tropic Arts ("we," "us," or "our") respects the intellectual property rights of others and expects the same in return. This policy outlines how we protect our own copyrighted works and how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

Our Intellectual Property

All Tropic Arts themes — including their source code, design patterns, visual assets, documentation, and related materials — are original works of authorship owned by Tropic Arts. These works are protected by United States copyright law and international copyright treaties.

Purchasing a Tropic Arts theme through the Shopify Theme Store grants you a limited license to use the theme on a single Shopify store as outlined in our Terms & Conditions. This license does not transfer ownership of the theme or any of its underlying intellectual property.

Prohibited Activities

The following activities constitute copyright infringement and are strictly prohibited: redistributing, reselling, or sublicensing any Tropic Arts theme in its original or modified form; uploading theme files to public repositories, file-sharing platforms, or "nulled" theme websites; extracting, repurposing, or repackaging our theme code, design patterns, or assets for use in another product or theme; and claiming authorship or ownership of any Tropic Arts theme or a substantial portion of its code or design.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been used on our website or in our products in a way that constitutes copyright infringement, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following information to be valid under the DMCA:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (such as a URL). Your contact information, including your name, address, telephone number, and email address. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Reporting Theme Piracy

If you encounter a Tropic Arts theme being distributed without authorization — on a file-sharing site, a "nulled" theme marketplace, a public code repository, or any other platform — we would appreciate your help in reporting it. Please send an email to our designated agent (listed below) with the URL of the infringing content and any relevant details. We take every report seriously and will pursue appropriate action to have unauthorized copies removed.

Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated agent. Your counter-notification must include a physical or electronic signature; identification of the material that was removed and the location at which it appeared before it was removed; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original notification.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed material within 10 to 14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat Infringers

In accordance with the DMCA and other applicable laws, we may terminate access to our services for users who are determined to be repeat infringers at our sole discretion.
