Welcome to Tropic Arts. These Terms & Conditions ("Terms") govern your access to and use of the Tropic Arts website located at www.tropic-arts.com (the "Site"), as well as any themes, documentation, support services, and related content we provide (collectively, the "Services"). By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

Tropic Arts ("we," "us," or "our") is a Shopify theme development company that designs and sells premium themes through the Shopify Theme Store and provides documentation and support for those themes.

Eligibility

By using our Site or Services, you represent that you are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. If you are using our Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Theme License and Usage

When you purchase a Tropic Arts theme through the Shopify Theme Store, you receive a license to use that theme in accordance with Shopify's standard theme licensing terms. Your purchase grants you a non-exclusive, non-transferable license to install and use the theme on a single Shopify store.

You may

Install the theme on one Shopify store per license purchased. Customize the theme's settings, content, and appearance through the Shopify theme editor or by modifying the theme code for your own store. Use the theme for commercial purposes on the store to which it is installed.

You may not

Resell, redistribute, sublicense, or otherwise make the theme available to any third party, whether in its original or modified form. Use a single license to install the theme on multiple Shopify stores. Claim authorship or ownership of the theme or any portion of its underlying code, design, or assets. Extract, repurpose, or repackage the theme's code, design patterns, or assets for use in another product or theme.

Purchases and Payments

All theme purchases are processed through the Shopify Theme Store. Pricing, payment processing, billing, and transaction handling are managed by Shopify and are subject to Shopify's Terms of Service. We do not directly collect or process payment information.

Theme prices are listed on the Shopify Theme Store and are subject to change at our discretion. Any applicable taxes are determined and applied by Shopify at the time of purchase.

Refund Policy

Refunds for theme purchases made through the Shopify Theme Store are governed by Shopify's refund policies. If you experience a technical issue with one of our themes, we encourage you to contact us first so we can work with you to resolve it. In many cases, issues can be addressed through support or a theme update.

If a refund is warranted and falls within Shopify's refund guidelines, we will work with Shopify to facilitate the process. Refund eligibility and timelines are ultimately determined by Shopify.

Theme Support

We provide support for our themes to help you with installation, configuration, and troubleshooting of features included in the theme as designed.

What support includes

Assistance with theme setup and configuration through the Shopify theme editor. Guidance on using the theme's built-in features and sections. Bug fixes for issues caused by the theme code itself. Answers to questions about theme functionality and documentation.

What support does not include

Custom development, bespoke design work, or modifications beyond the theme's built-in settings and features. Troubleshooting issues caused by third-party apps, custom code you have added, or conflicts introduced by other modifications to your store. General Shopify platform support, store setup assistance, or guidance unrelated to our themes. Training on Shopify administration, Liquid templating, or web development.

We aim to respond to all support inquiries in a timely manner, but response times may vary based on volume and complexity.

Intellectual Property

All content on the Tropic Arts website — including but not limited to text, graphics, logos, images, design elements, code, documentation, and theme demos — is the property of Tropic Arts or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our Site without our prior written consent, except as expressly permitted by these Terms or applicable law.

The Tropic Arts name, logo, and all related product names and branding are trademarks of Tropic Arts. Use of our trademarks without prior written permission is prohibited.

Acceptable Use of Our Website

You agree to use our Site and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any manner that could disable, overburden, damage, or impair it; attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems; use any automated system, including bots, scrapers, or crawlers, to access the Site for any purpose without our express written permission; or introduce any viruses, malware, or other harmful material.

Our Site may contain links to third-party websites, platforms, or services that are not owned or controlled by Tropic Arts. We are not responsible for the content, privacy practices, or policies of any third-party sites. Inclusion of a link does not imply our endorsement of the linked site or any association with its operators. Disclaimers

Our Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Site will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific results from the use of our themes, including but not limited to increases in traffic, conversion rates, or revenue. While our themes are designed to meet high standards of performance and quality, results will vary depending on your content, configuration, third-party apps, and other factors outside our control.

Limitation of Liability

To the fullest extent permitted by applicable law, Tropic Arts and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site, Services, or themes. This includes, without limitation, damages for lost profits, lost revenue, lost data, business interruption, or any other intangible losses, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or your use of our Services exceed the amount you paid to us, if any, during the twelve (12) months preceding the event giving rise to the claim.
